Owners' assembly (Kat malikleri kurulu)

Definition

Under Turkish condominium law, the body made up of all unit owners of a main property and the highest decision-making authority in its management.

The assembly has authority over the management of the main property and over the relations of unit owners with one another: it elects the manager and the auditor, approves the operating budget plan, releases the manager, and decides on the use of common areas and on major expenditures.

The assembly holds an ordinary meeting at the time set in the management plan, and in any case at least once a year; when necessary, it is called to an extraordinary meeting. Decisions are written in the resolution book and signed by those attending.

Voting rights at the assembly belong to the unit owners; a unit owner may be represented by a proxy.
