Management and assembly

Decision quorum (voting majority) (Karar yeter sayısı)

Also known as: majority vote, unanimity, four-fifths, oy çokluğu

Definition

The majority of votes required for a decision of the owners' assembly to be validly taken under Turkish condominium law.

Unless otherwise specified in the law, the assembly decides by a majority of the votes of those attending. Some important decisions, however, require a qualified majority or unanimity; for example, amending the management plan requires the votes of four-fifths of all unit owners.

Which matter is subject to which majority is set out in the law and the management plan; checking these ratios before important decisions reduces the risk of a later annulment lawsuit.
