Definition
The rule that determines how a common expense is shared among the independent units: equally, by land share, m², coefficient, number of occupants and so on.
Unless the owners have agreed otherwise, the law provides that some expenses are shared equally and others in proportion to land share; the management plan or an agreement among the unit owners may set different bases. If it is not clearly decided which expense is distributed on which basis, disputes are inevitable.
- Equal: each independent unit pays the same share (e.g. the building attendant's wages).
- Land share: in proportion to the land share on the title deed (e.g. repair of common areas, insurance).
- Square meters: by the floor area of the independent unit.
- Coefficient: with a weight assigned to unit types such as shops or duplexes.
- Number of occupants: by the number of people living in the household (e.g. shared water).
