Expense share (Gider payı)

Also known as: common expense share, service charge share, cost share, KMK 20

Definition

The share of the main property's common expenses that each unit owner must bear; regulated in Article 20 of Turkey's Condominium Ownership Law (KMK).

Under KMK art. 20, unless the owners have agreed otherwise, unit owners contribute equally to the costs of the building attendant, boiler operator, watchman and gardener; and in proportion to their land share to insurance premiums, the maintenance, protection and repair costs of common areas, and the operating costs of common facilities. Contributing to the advance decided by the assembly is also among the obligations in the same article.

If the management plan sets a different sharing basis, that basis applies. A unit owner cannot avoid paying their expense share by declaring that they waive the use of the common areas and facilities.

If the expense share is not paid on time, late payment compensation accrues at 5% per month; the other unit owners also have a statutory mortgage right for this receivable.
