Monthly dues (Aidat)

Definition

Under Turkish condominium law, the money unit owners pay the management regularly to cover common expenses; legally it is the expense share and the advance.

“Aidat” is the everyday term; in the Condominium Ownership Law (Kat Mülkiyeti Kanunu) it corresponds to the “expense share” (gider payı) and the “advance” (avans). Common expenses such as the building attendant's wages, electricity and water for common areas, cleaning, elevator maintenance, insurance and minor repairs are covered by the dues.

The amount is set according to the operating budget plan (annual budget) approved by the owners' assembly (kat malikleri kurulu). Unless the owners have agreed otherwise, some expenses are shared equally and some in proportion to land share; the management plan may set different rules.

Example: In a 50-unit complex with projected annual common expenses of 1,200,000 TL, the budget is distributed among the units according to the sharing basis in the operating budget plan and charged as dues in 12 monthly installments.

If dues are not paid on time, late payment compensation accrues by law; for debts left unpaid for a long time, enforcement proceedings can be started.
