Advance payment (Avans)

Definition

Under Turkish condominium law (KMK), money collected in advance from unit owners by decision of the owners' assembly so that common expenses can be met on time.

Under the Condominium Ownership Law, unit owners are obliged to contribute not only to common expenses but also to the advance decided by the owners' assembly (kat malikleri kurulu). The advance ensures the management has cash on hand before expenses arise; in practice, most of the monthly dues are advances based on the operating budget plan.

Late payment compensation also accrues when an advance is paid late, just as with the expense share. If the actual expenses at year-end are lower than the advances collected, the difference may, by decision of the assembly, be refunded, carried over to the next period or set aside in the reserve fund.

In everyday usage, a payment a resident makes in excess of their debt is also called an advance: the excess amount is held as a credit to be offset against future charges.
