Distance sales agreement

Seller (the "Seller"):

Buyer (the "Buyer"): the natural or legal person who buys a CasaX subscription through casax.com.tr and, at the payment step, declares their full name or company name, Turkish national ID number or tax number, address, email address and phone number.

This agreement governs the rights and obligations of the parties regarding the CasaX subscription purchased electronically by the Buyer, in accordance with Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation. The pre-contract information form provided to the Buyer before the purchase is an integral part of this agreement.

• Service: access to the CasaX residential complex management software via the web, iOS and Android according to the selected plan. Plan limits (units, residential complexes, team members, monthly assistant messages) are stated in the order summary and on the pricing page.
• Term: monthly or annual; unless canceled, it renews with the same plan at the end of the period.
• Price: VAT is added to the price excluding VAT shown at the time of the order; the total price including taxes is shown at the payment step. The annual price equals the price of 10 months.
• Payment: in advance by credit or debit card through iyzico; renewals are charged automatically to the saved card. Card details do not reach the Seller.
• Receipt and invoice: a receipt is created in the panel for each payment; the invoice is issued based on the billing information declared by the Buyer.

Once the payment is confirmed, the selected plan is activated immediately in the Buyer's organization; no separate delivery is made.

• The Seller provides the service with the characteristics stated in the pre-contract information form and the terms of use.
• The Buyer is responsible for the accuracy of the billing information and the security of their account, and uses the service in accordance with the terms of use.
• As the data controller for the records they enter into the service, the Buyer complies with personal data protection legislation.

The service is performed instantly in electronic form once the payment is confirmed. Under Distance Contracts Regulation art. 15/1-(ğ) and (h), the right of withdrawal cannot be exercised, since the Buyer approves at the payment step that performance begins immediately.

• The Buyer can cancel the subscription at any time in the subscription settings in the panel. Cancellation takes effect at the end of the paid period; the service remains available until the end of the period, and no new payment is taken.
• No refund is given for a used or started period.
• When the plan is changed, the new plan starts with a new period as soon as the payment is confirmed, and the period fee of the new plan is charged; no cash refund is given for the unused days of the previous plan.
• When the subscription ends, records are not deleted; the management panel becomes read-only, and the resident panel continues to work.

Purchases made in the iOS and Android apps take place through the App Store or Google Play; payment, renewal, cancellation and refunds are subject to the terms of the relevant store.

The Buyer's personal data is processed in accordance with the privacy notice under the Turkish Personal Data Protection Law (KVKK) and the privacy policy.

Complaints are sent to info@casax.com.tr. A Buyer who is a consumer may apply to consumer arbitration committees within the monetary limits set by the Turkish Ministry of Trade, and to consumer courts above these limits.

The Buyer approves this agreement electronically at the payment step; the agreement enters into force when the payment is confirmed.
