Definition
Turkey's Law No. 634, which governs ownership of independent units, common areas, expenses and management in apartment buildings and residential complexes.
Condominium Ownership Law No. 634 was adopted in 1965 and underwent its most comprehensive amendment in 2007 through Law No. 5711; provisions on collective building complexes (toplu yapı) were also added by this amendment.
The law governs the establishment of condominium ownership and floor easement; the concepts of independent unit, annex and common areas; the rights and obligations of unit owners; expense and advance shares; the owners' assembly; the manager; and auditing. The details are completed by each building's management plan.
Disputes arising from the law are, as a rule, heard by the civil court of peace (sulh hukuk mahkemesi); it may also be necessary to apply to mediation before filing a lawsuit.
