Definition

Under Turkish law, the ownership right established over the separately usable units of a completed building, linked to a land share.

Condominium ownership is established over the independent units (apartment, shop, office, storage unit) once the building is completed, and a separate page is opened in the land registry for each unit. The unit owner is the sole owner of their independent unit; in the land and the common areas, they are a co-owner in proportion to their land share.

Condominium ownership usually arises after the occupancy permit (iskân) is obtained, by converting a previously established floor easement into condominium ownership.

A condominium ownership title deed is preferred in sale and loan transactions because it shows that the independent unit is in a completed building with an occupancy permit.
