Floor easement (Kat irtifakı)

Definition

Under Turkish law, an easement established on the land, tied to a land share, for the independent units of a building not yet completed or yet to be built.

Floor easement records in the land registry who each independent unit will belong to, and its land share, before construction is finished. It is established according to the building project; while construction is ongoing, or when the building is finished but no occupancy permit has been obtained, the title deeds appear as floor easement titles.

When the building is completed and the occupancy permit is obtained, the floor easement is converted into condominium ownership. Since a management plan is also submitted when floor easement is established, buildings that are moved into without an occupancy permit are still managed under the management plan and the provisions of the law.
