KVKK privacy notice (KVKK aydınlatma metni)
Also known as: KVKK, privacy notice, personal data, explicit consent
Definition
Under Turkey's data protection law (KVKK), the notice telling individuals why and on what legal basis their personal data is processed and to whom it is transferred.
Law No. 6698 on the Protection of Personal Data (KVKK), Article 10, obliges the data controller to inform data subjects when personal data is collected. The notice states the identity of the data controller, the purposes of processing, to whom the data may be transferred, the method of collection, the legal basis and the data subject's rights.
In sites and apartment buildings, the resident directory, vehicle license plates, visitor records and camera footage are personal data; as a rule, the site management is the data controller for these records. Informing data subjects is different from explicit consent: information must be provided in every case, whereas explicit consent is needed only if none of the other processing conditions in the law apply.
In CasaX
In CasaX, KVKK consent is recorded in the resident directory. The management is the data controller for site records; CasaX processes these records as a data processor on the management's instructions.
