Definition

Under Turkish condominium law, the owner of an independent unit in a building under condominium ownership, who co-owns the common areas in proportion to their land share.

The unit owner is the owner of the independent unit as registered on the title deed. An independent unit may have more than one owner; in that case, the owners choose from among themselves the person who will represent them at the owners' assembly (kat malikleri kurulu).

Main rights: to use, rent out and sell the independent unit; to vote at the assembly; to demand accounts from the manager. Main obligations: to pay the expense and advance share, to use the common areas with care, and to observe the rules of good faith in relations with the other owners.

A tenant or a family member living in the unit is not a unit owner; however, the law provides that the tenant is also liable for the expense and advance share together with the owner.
