Definition
The process governing the demolition and reconstruction of buildings and areas at disaster risk in Turkey; its main legal basis is Law No. 6306.
Law No. 6306 on the Transformation of Areas under Disaster Risk sets out procedures for identifying, demolishing and rebuilding risky buildings. The process usually begins with an application by one of the owners and a risky building assessment carried out by a licensed institution.
Once the risky building designation becomes final, decisions on reconstruction are taken by the qualified majority set out in the law and in proportion to shares. Since support such as rent assistance, loan support and tax exemptions may change from period to period, current legislation should be checked.
When a transformation decision is taken, it is important to clarify by assembly decision how existing dues debts, the reserve fund, and staff and maintenance contracts will be closed out.
