Usufruct right (İntifa hakkı)
Definition
A limited real right registered on the title deed that lets a person use and benefit from another's property (e.g. live in it or rent it out).
Usufruct is regulated in the Turkish Civil Code. A common example is a parent who transfers the bare ownership of a property to their children and establishes a usufruct in their own favor so that they can live in it or collect the rental income for life.
As a rule, usufruct cannot be transferred, and for natural persons it ends with the death of the holder. The owner on the title deed and the holder of the usufruct may be different people.
What matters for site management is who lives in the independent unit and from whom the common expenses are to be requested. In a specific case, the land registry record and the agreement between the parties should be taken as the basis.
