Definition
Resolving a dispute by negotiation with a neutral mediator, without going to court; in Turkey it is a precondition for suing in many condominium disputes.
The mediator brings the parties together and helps them find a solution; the mediator does not make a decision. If the parties reach agreement, the signed agreement document may, under the conditions set by law, be treated as equivalent to a court judgment.
Since 2023, applying to a mediator before filing a lawsuit has been a precondition for suing in disputes arising from the Condominium Ownership Law. For matters such as dues receivables, expense sharing or the use of common areas, whether this step is required before suing should be checked with a lawyer.
