Enforcement proceedings (İcra takibi)

Definition
In Turkey, the legal process started through the enforcement office to forcibly collect unpaid receivables such as dues and expense shares.
For dues receivables, enforcement without a judgment (ilamsız icra, i.e. proceedings by general attachment) is usually started in practice. The enforcement office sends the debtor a payment order; if the debtor does not object within seven days of service, the proceedings become final and the attachment stage can begin.
If the debtor objects, the proceedings stop; the creditor then seeks removal of the objection or annulment of the objection. A duly finalized operating budget plan and assembly decisions are the strongest grounds for the receivable at this stage.
Sending the debtor a written notice before the proceedings and having the debt breakdown and the late payment compensation calculation ready speeds up the process. Getting support from a lawyer is recommended for the decision to start proceedings and for the costs.
