Precautionary attachment (İhtiyati haciz)

Definition

In Turkey, a temporary attachment placed on a debtor's assets by court order before proceedings or a lawsuit conclude, to secure collection of a receivable.

Precautionary attachment is, as a rule, requested from the court for a monetary receivable that is due and not secured by a pledge. The court usually asks the creditor for security; if the attachment is granted, proceedings must be started or a lawsuit filed within the period set by law.

For dues receivables, ordinary enforcement proceedings are used more often; precautionary attachment comes up in special situations, such as the risk that the debtor will hide assets. Since the conditions and the security vary with the specific case, legal support should be sought.
