Representation by proxy (Vekâletle temsil)
Also known as: proxy, proxy vote, power of attorney, vekâlet
Definition
A unit owner not attending an assembly meeting in person but sending someone else with a written proxy to vote on their behalf.
A unit owner may be represented at the owners' assembly by a proxy. In practice, the proxy is required to be in writing and to be attached to the attendance list at the start of the meeting.
The law limits one person representing many unit owners: one person cannot represent more than five percent of the unit owners; if there are fewer than twenty unit owners, one person can represent only one unit owner.
If an independent unit has more than one owner, the owners choose from among themselves the person who will represent them at the assembly.
